1. Promotion Overview
   The Elektra Go New User Promotion offers a $0 fee + Special FX for the first money transfer when new users send money from the Elektra Go app using the promotional code “SEND”. 
   This Promotion is valid from March 1, 2025, to June 30, 2025, or until the first 5000 qualifying users have redeemed the offer, whichever comes first.

2. Eligibility

• • Age Requirement: Participants must be 18 years of age or older at the time of entry.
  • Residency: This Promotion is open only to legal residents of the United States.
  • New Users Only: The Promotion is exclusively available to individuals who have not previously sent money from the Elektra Go app. Existing users or individuals who have previously sent money with the Elektra Go app are not eligible.
  • Account Registration: Participants must download the Elektra Go app, register for a new account, and enter the promotional code “SEND”. 

3. Promotion Details

• • Fee Waiver: The Promotion grants a fee waiver for the first money transfer performed through the Elektra Go app. The transaction is subject to a maximum transfer amount of $700 USD.
  • Validity Period: Transfers must be initiated and completed by June 30, 2025, at 11:59 p.m. Central Time (CT) to be eligible for the fee waiver and Special FX. 
  • First-Come, First-Served: The Promotion is available on a first-come, first-served basis for the first 5,000 users who sign up for Elektra Go between March 1, 2025, and June 30, 2025, at 11:59 p.m. CT.
  • Promotional Code Use: The promotional code “SEND” must be entered during the money transfer process to apply the fee waiver + Special FX. The code is valid for a single use per new user.
  • Service Limitations: Standard data and messaging rates from wireless service providers may apply when using the Elektra Go app. The Promotion is limited to one offer per user or device. 

4. Exclusions and Limitations

• • Transfer Limits: The fee waiver + Special FX is limited to the first money transfer only. Subsequent transfers will be subject to the standard fees and FX as outlined in the Elektra Go app.
  • Non-Transferable: This Promotion is non-transferable and cannot be combined with any other offers or promotions.
  • Void Where Prohibited: The Promotion is void where prohibited by law.

5. Disclaimers

• • Remittance Services: Fraternitas, LLC and Central Bank of Kansas City do not administer nor are they liable for remittance transfers. Remittance services are provided by Servicio UniTeller, Inc.   • State Licensing: Servicio UniTeller, Inc. is licensed in every state that requires a license.
  • No Cash Value: The Promotion has no cash value and cannot be exchanged for cash or any other benefits.
  • No Guarantee of Availability: Elektra Go makes no guarantees regarding the availability of the Promotion. The Promotion may be suspended, modified, or terminated at any time for any reason, including but not limited to system errors, fraud, or technical issues.
  • Limitation of Liability: To the fullest extent permitted by law, Elektra Go, Fraternitas, LLC, Central Bank of Kansas City, and their respective affiliates, officers, directors, employees, and agents disclaim any and all liability for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with participation in the Promotion, use of the Elektra Go app, or any services provided by Servicio UniTeller, Inc., even if Elektra Go has been advised of the possibility of such damages.
  • Indemnification: By participating in the Promotion, participants agree to indemnify, defend, and hold harmless Elektra Go, Fraternitas, LLC, Central Bank of Kansas City, Servicio UniTeller, Inc., and their respective affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to their participation in the Promotion, use of the Elektra Go app, or any violation of these terms and conditions.
  • No Warranty: Elektra Go provides the Promotion and the Elektra Go app on an “as-is” and “as available” basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or title. Elektra Go does not warrant that the Promotion or the Elektra Go app will be uninterrupted, error-free, or free from viruses or other harmful components.

6. Intellectual Property

• • Trademarks: Google Play and the Google Play logo are trademarks of Google LLC. Apple and the Apple logo are trademarks of Apple Inc., registered in the U.S. and other countries. App Store is a service mark of Apple Inc., registered in the U.S. and other countries.
  • License: By participating in the Promotion, users agree to comply with all applicable terms of use, privacy policies, and intellectual property rights associated with the Elektra Go app and its related services.

7. Modifications and Termination

• • Right to Modify: Elektra Go reserves the right to modify, suspend, or terminate this Promotion at any time without prior notice. Any changes will be effective immediately upon posting to the Elektra Go app or website.
  • Early Termination: The Promotion will automatically terminate once the first 5,000 qualifying users have redeemed the offer or at 11:59 p.m. CT on June 30, 2025, whichever occurs first.

8. Governing Law
   These terms and conditions shall be governed by the laws of the State of Texas except to the extent governed by federal law.
   
   
9. Dispute Resolution

• • Arbitration: Any disputes arising out of or relating to this Promotion shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in the state of residence of the participant, and the decision of the arbitrator shall be final and binding.
  • Class Action Waiver: Participants agree that any arbitration shall be conducted on an individual basis, and not as a class, collective, or representative action. Participants further agree that they shall not participate in any class, collective, or representative action brought by any other party in connection with this Promotion.
  • Limitation of Actions: Any claim or cause of action arising out of or relating to this Promotion must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred.

10. Data Privacy

• • Personal Information: By participating in the Promotion, participants agree to the collection, use, and disclosure of their personal information as described in the Elektra Go Privacy Policy, which is available at https://elektrago.app/Documents/PPEG.
  • Third-Party Sharing: Participants acknowledge that their personal information may be shared with third-party service providers for the purpose of administering the Promotion and providing the remittance services. Elektra Go, Fraternitas, LLC, Central Bank of Kansas City, and Servicio UniTeller, Inc. are not responsible for the privacy practices of these third-party service providers.
  • Opt-Out: Participants may opt-out of receiving promotional communications from Elektra Go by following the instructions provided in the communication. However, opting out of promotional communications may affect participants’ ability to participate in future promotions.

11. General Conditions

• • Force Majeure: Elektra Go is not responsible for any delays, interruptions, or failures in the performance of the Promotion or the Elektra Go app due to circumstances beyond its control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, technical failures, or governmental actions.
  • Severability: If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
  • Entire Agreement: These terms and conditions constitute the entire agreement between participants and Elektra Go with respect to the Promotion and supersede all prior or contemporaneous communications and proposals, whether oral or written, between the parties with respect to the Promotion.
  • No Waiver: Elektra Go's failure to enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision.

1. ELIGIBILITY:
   1. NO PURCHASE IS NECESSARY TO ENTER OR CLAIM A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Chistes de Papá Giveaway (the “Sweepstakes”) is open to residents of the 50 United States and the District of Columbia, age 18 years or older at the time of entry, except employees, their spouses and immediate families (parent, child, sibling, and any of their respective spouses) and household members (whether or not related) of Fraternitas, LLC dba Elektra USA (“Sponsor”), and each of their respective parent, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, affiliates, advertising and promotion agencies and affiliated entities (collectively, including Sponsor, the “Sweepstakes Entities”).
   2. The Sweepstakes is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. By entering the Sweepstakes, entrants agree to accept and be bound by all terms of these official rules (“Entrant”) (“Official Rules”). Void where prohibited by law.   
2. HOW TO ENTER:
   1. From Monday, April 14th, 2025, at 12:00 pm Central Time (“CT”), through Sunday, April 20th, 2025, at 11:59 pm CT (the “Entry Period”), Sponsor will conduct a Sweepstakes encouraging participants to enter for a chance to win a prize. There is one (1) way to enter the Sweepstakes:
      One way is for the entrant to visit the official Elektra Go Instagram or Facebook page and follow the instructions detailed in the post. Another way is to complete and submit the online form, including entrant’s name, address, telephone number, email address, and any other information requested on the form. Entrant will receive one (1) entry for each qualified registration. To be eligible, each Sweepstakes entry must be received no later than Sunday, April 20th, 2025, at 11:59 pm CT. LIMIT ONE (1) VALID ENTRY PER PERSON PER CALENDAR DAY.
   2. Entries generated by script, macro or other automated means will be void. 3. HOW TO WIN:
   1. On or around Monday, April 21st, 2025, three (3) potential winners (when verified by Sponsor as set forth below, and each of them the “Winner”) will be selected in a random drawing from all eligible entries received during the Entry Period.
      Each potential Winner will be notified by Sponsor via email and/or telephone and must meet all eligibility requirements, including timely replying to the notification and execution and return of all necessary releases and documents (if any) required by Sponsor and/or Administrator. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules. Odds of winning depend on the number of eligible entries received.
   2. If there is a dispute as to the identity of a Winner, the winning entry will be declared to have been made by the authorized email account holder at time of entry. Such potential Winner will be disqualified, the prize will be forfeited and an alternate potential Winner will be selected by alternate random drawing from among all remaining eligible entries and an alternate Winner may be selected at Sponsor’s sole and absolute discretion if: (i) any prize notification is returned as undeliverable; (ii) a potential Winner declines his or her prize; (iii) a potential Winner fails to comply with any of the Official Rules; or (iv) a potential Winner does not respond to notification or accept the prize within forty-eight (48) hours.
   3. The decisions of Sponsor in all matters regarding this Sweepstakes are final and binding. 
      
      
4. PRIZE:
   1. Each (1) Winner will Receive:

   3. No substitution or transfer of prizes or cash redemption is permitted. Sponsor reserves the right to substitute a prize (or portion thereof) of comparable or greater value, in its sole discretion. There will be no substitutions if the Winner is unable for any reason to use or accept the prize. If any portion of the prize is canceled or postponed for any reason, no prize will be provided in lieu thereof, nor will Sponsor award an alternate prize or cash value or any part of the prize.  Prizes may be subject to certain terms and conditions as specified by Sponsor or by the issuer of the Prizes.
   4. Winner is responsible for the reporting and payment of all federal, state and local taxes (if any) and any other costs and expenses associated with prize acceptance and use not specified in these Official Rules and/or in the applicable entry instructions as being provided. Prize will be fulfilled within a reasonable time of Sponsor’s verification of Winner. GENERAL: By entering this Sweepstakes, entrant grants Sweepstakes Entities and their designees the right, unless prohibited by law, to use their names, user names, entries, cities and states of residences, voices, avatars, pictures and likenesses, without compensation, notification or approval, for the purpose of advertising and publicizing the goods and services of the Sweepstakes Entities and all matters related to the Sweepstakes, in any manner or medium, now or hereafter known, throughout the world in perpetuity. 6. DISPUTES:
   1. Except where prohibited, entrants agree that: (i) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes or any prize awarded will be resolved individually, without resort to any form of class action and exclusively by the appropriate court located in the State of Texas; (ii) any and all claims, judgments, and awards to entrants will be limited to actual out of pocket costs incurred, including costs associated with participating in this Sweepstakes, but in no event attorneys’ fees; and (iii)  under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages, and any other damages other than for actual out of pocket expense and any and all rights to have damages multiplies or otherwise increased.
